You need to check this with your Start-up endorsing body. Note that you cannot be endorsed for the Start-up visa if you have previously established a business in the UK under your DES leave. Also, it is not a Tier 1 or other PBS visa but is under the new Immigration Rules Appendix W: Immigration Rules for Workers.
